| I am a part-time Commissioner at the CCMA and I advise and assist employers on how best to not land up in front of me or one of my colleagues! Of course the right to refer a matter remains, and if an employee does refer, then I will make sure that the employer is as best prepared as is possible. As a Commissioner I am unfortunately precluded from representing a party at the CCMA. I also advise and assist employees in understanding their rights as legislated. I am often used as an independent chairperson in disciplinary enquiries and in mediating conflict within the workplace. My approach is that there is a relationship that exists between an employer and an employee and its harmony is essential for the success of that business. Harmony is achieved through applying the law and being "fair". Even when the relationship has to be terminated, it is done in a "fair" way and thereby often improves the relationship that the employer enjoys with the rest of the employees. |
